Terms and Conditions

Effective date: April 14, 2026

By using the ReefIQ mobile application, firmware, hardware devices, or related cloud services (collectively, the "Service"), you agree to these Terms and Conditions. If you do not agree, do not use the Service.

1. Definitions

• "BayTech Software" (also "we", "us", "our") refers to the entity that develops and operates ReefIQ.
• "ReefIQ" refers to the mobile application, firmware, hardware devices, and cloud services provided by BayTech Software.
• "User" (also "you", "your") refers to any individual who uses the Service.

2. Account Registration

• You must create an account to use cloud-connected features. Account creation is available via email/password, Google Sign-In, or Sign in with Apple.
• You must verify your email address to access certain features.
• You are responsible for maintaining the confidentiality of your account credentials. Do not share your password with others.
• You must provide accurate information during registration. You may not create accounts for fraudulent or unlawful purposes.
• You must be at least 13 years of age to create an account.

3. Acceptable Use

You may use ReefIQ for personal, non-commercial aquarium management. You agree not to:

• Reverse-engineer, decompile, or disassemble the software, firmware, or related services
• Redistribute, sublicense, or create derivative works from the Service
• Use the Service for any unlawful, abusive, or harmful purpose
• Attempt to gain unauthorized access to other users' data or our infrastructure
• Circumvent rate limits, usage quotas, or security measures
• Use automated tools (bots, scrapers) to access the Service without authorization

4. Device Control

ReefIQ communicates with hardware devices (Flo, Specto, Cora, and other devices) over your local network and via Bluetooth Low Energy (BLE) during provisioning. You are responsible for:

• The safe operation of your aquarium equipment
• Proper equipment maintenance, monitoring, and safety precautions
• Your local network configuration and security

ReefIQ is a control and monitoring interface. It does not replace direct equipment supervision, safety devices, or professional aquarium maintenance.

5. Neptune Apex Integration

ReefIQ can connect to a Neptune Systems Apex controller on your local network. This integration:

• Operates entirely over your local network — data does not pass through our servers
• Stores your Apex IP address and credentials locally on your device in encrypted storage
• Is not affiliated with, endorsed by, or supported by Neptune Systems

You are responsible for the accuracy and security of your Apex credentials.

6. AI-Powered Features

6.1 ReefIQ Assistant (Text and Voice)

The ReefIQ Assistant provides general reef aquarium guidance powered by OpenAI. Key terms:

• Text chat messages and responses are stored in Firebase Firestore under your account. A limit of 100 messages per day applies.
• Voice chat audio is transmitted in real time to OpenAI's Realtime API for processing. Voice sessions are ephemeral — audio is not stored by BayTech Software.
• All AI-generated responses are advisory only. They do not constitute professional advice and should not replace your own testing, research, or consultation with qualified reef experts.

6.2 ICP Report Analysis

When you upload an ICP (water analysis) report PDF, the document is processed by OpenAI's GPT API to extract and analyze parameters. The uploaded PDF and analysis results are stored under your account.

6.3 Health Reports

Health reports are generated by sending your tank data (parameters, livestock, journal entries) to OpenAI's GPT API. Reports are AI-generated assessments and are advisory only.

6.4 Journal AI Correlations

Journal entries may be analyzed by OpenAI's GPT API to identify correlations between your actions and tank parameter changes. These correlations are advisory only.

6.5 Disclaimer for All AI Features

BayTech Software is not liable for any outcomes resulting from following AI-generated advice, analysis, or recommendations. AI features use third-party models (OpenAI) that may produce inaccurate, incomplete, or inappropriate responses. You use AI features at your own risk.

7. Push Notifications

ReefIQ uses Firebase Cloud Messaging (FCM) to deliver push notifications for:

• Maintenance task reminders
• Parameter alert triggers

You can disable notifications at any time through your device settings or within the app.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. Key points:

• Account data, tank profiles, parameters, livestock, journal entries, assistant history, health reports, and maintenance tasks are stored in Firebase (Google Cloud)
• Device telemetry is stored in Firebase Realtime Database
• ICP report PDFs are stored in Firebase Storage
• Local data (preferences, Apex credentials) is stored in encrypted local storage on your device
• You may delete your account and all associated data at any time from within the app

9. Account Deletion

You may delete your account at any time from the app (Settings > Delete Account). Upon deletion:

• Your authentication account is permanently removed
• All associated cloud data (Firestore, Realtime Database, Storage) is permanently deleted via a GDPR-compliant cascade
• Local data on your device remains until you uninstall the app

This action is irreversible.

10. Intellectual Property

ReefIQ, including its mobile application, firmware, hardware designs, cloud functions, branding, and all related assets, is the intellectual property of BayTech Software. All rights are reserved.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial aquarium management, subject to these Terms.

11. Third-Party Services

ReefIQ integrates with third-party services including Firebase (Google), OpenAI, Google Sign-In, and Sign in with Apple. Your use of these services is subject to their respective terms:

• OpenAI Terms of Use
• Apple Terms and Conditions

BayTech Software is not responsible for the availability, accuracy, or conduct of third-party services.

12. Limitation of Liability

The Service is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

BayTech Software is not liable for any damages arising from your use of the Service, including but not limited to:

• Equipment damage or malfunction
• Livestock injury or loss
• Data loss or corruption
• Consequences of following AI-generated advice
• Interruptions in service availability
• Actions taken based on parameter readings, alerts, or reports

Your total liability to BayTech Software, and BayTech Software's total liability to you, shall not exceed the amounts you have paid to BayTech Software in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless BayTech Software from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service ceases immediately
• We may delete your account and associated data
• Sections that by their nature should survive termination (Limitation of Liability, Indemnification, Intellectual Property) shall survive

15. Changes to These Terms

We may update these Terms as the Service evolves. The effective date at the top of this page indicates the latest revision. Continued use of the Service after changes constitutes acceptance of the updated Terms. If we make material changes, we will make reasonable efforts to notify you.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law provisions.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
